The European Union is giving companies more breathing room to comply with its landmark AI Act, but the clock is still ticking. The EU Council agreed in March 2026 to delay the full enforcement of rules governing high-risk AI systems, pushing the application date from August 2, 2026, to December 2, 2027, for standalone systems and August 2, 2028, for AI embedded in regulated products. This extension comes as the EU attempts to balance innovation with safety, but it also reveals a critical gap: many organizations still don't know whether their AI systems qualify as "high-risk" under the law. What Obligations Take Effect Before the December 2027 Deadline? The extended timeline applies specifically to high-risk AI system requirements. Other obligations remain on their original schedule. Transparency requirements under Article 50, which mandate disclosure of AI interactions and labeling of synthetic content, became enforceable on August 2, 2026. Companies deploying generative AI systems must now inform users when they are interacting with AI, and must label deepfakes and AI-generated text on matters of public interest. Deployers of high-risk AI systems face immediate obligations regardless of the enforcement delay. These include using systems strictly according to provider instructions, implementing appropriate human oversight, monitoring system performance continuously, and reporting serious incidents without delay. If deployers control input data, they must ensure its relevance and representativeness. They must also conduct data protection impact assessments or fundamental rights impact assessments before deployment in sensitive use cases, such as creditworthiness assessments, insurance pricing, or public-sector decision-making. The Council's decision also extended certain regulatory exemptions granted to small and medium-sized enterprises (SMEs) to small mid-caps (SMCs), reducing compliance burden for smaller organizations. However, this relief is limited and does not eliminate high-risk obligations entirely.
